What happens when both sides are allowed to place a control mark token in the sea zone? No supply for both sides?

Both side owning a sea zone will not happen. Who ever gets to a sea zone first is considered the defender. If the other side wishes to contest the zone - they have up to 4 rounds of attack to return/destroy defending aircraft or make the defender retreat. If the attacker doesn't clear the zone of active naval surface units or aircraft - the defender retains ownership  of the zone.
